The Sweet Marshmallow Co. Instagram Giveaway (the “Contest”) begins on May 1, 2026 at 12:00 AM Eastern Time (“ET”) and ends on May 15, 2026 at 11:59 PM ET (the “Contest Period”). Entries submitted before or after the Contest Period will not be eligible. Sponsor’s computer is the official timekeeping device for this Contest.

The Contest is open to legal residents of Canada (including Quebec) and the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age (or the age of majority in their jurisdiction of residence, whichever is greater) at the time of entry.

The following are NOT eligible to enter:

• Employees of Sweet Marshmallow Co. and its affiliates, subsidiaries, advertising and promotion agencies, and suppliers;
• Immediate family members (spouse, parents, siblings, children) and household members of such employees, whether or not related;
• Residents of any jurisdiction where this Contest is prohibited or restricted by law.
• The Contest is void where prohibited by applicable law.

To enter the Contest during the Contest Period, you must complete ALL of the following steps on Instagram:

• Follow @sweetmarshmallowco on Instagram;
• Like the official Contest giveaway post; and
• Tag one (1) friend in the comments section of the Contest post (one tag per comment = one entry).

Additional entries: Each separate comment containing a unique tag of a different friend constitutes one (1) additional entry. Tags must be of real Instagram users who have given permission to be tagged. Tagging the same friend multiple times will not generate additional entries.

Automated, robotic, scripted, or programmatic entries are prohibited and will be disqualified. Only entries submitted via a valid personal Instagram account will be accepted. Entries that do not comply with these Rules will be void.

Instagram account must be set to public during the Contest Period, or @sweetmarshmallowco must be following the entrant.

One (1) Grand Prize will be awarded, consisting of:

• One (1) 3-pack of Sweet Marshmallow Co. jumbo gourmet marshmallows in 6 different flavours
• Approximate Retail Value (ARV): $99.58 CAD / approximately $73.00 USD

The prize is non-transferable, has no cash equivalent, and may not be substituted or exchanged except at the Sponsor’s sole discretion. The Sponsor reserves the right to substitute a prize of equal or greater value if the stated prize becomes unavailable. The winner is responsible for all applicable taxes and shipping-related fees not expressly covered by the Sponsor.

On or about May 16, 2026, the Sponsor will conduct a random draw from all eligible entries received during the Contest Period to select one (1) potential winner. The odds of winning depend on the total number of eligible entries received.

The potential winner will be notified via Instagram Direct Message (“DM”) within [48/72] hours of the draw. The potential winner must respond to the DM within five (5) business days of notification. Failure to respond within this period, or failure to satisfy all eligibility requirements, will result in disqualification and an alternate winner will be selected by random draw from the remaining eligible entries.

Skill-Testing Question (Canadian residents only)

Before being declared the winner, any Canadian resident selected must correctly answer, without assistance, a time-limited mathematical skill-testing question administered by the Sponsor. The question will consist of a multi-step arithmetic equation following the standard order of operations (BEDMAS). Failure to correctly answer the skill-testing question will result in disqualification.

The winner will be publicly announced on @sweetmarshmallowco’s Instagram account on or around May 17, 2026. The Sponsor may require the winner to complete and return a winner release and declaration form as a condition of receiving the prize.

• This Contest is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms, Inc. Entrants release Instagram and Meta from all liability in connection with this Contest.

• By entering, participants consent to the Sponsor’s use of their Instagram handle and entry for promotional purposes, without further compensation, where permitted by law.

• The Sponsor reserves the right to cancel, modify, or suspend the Contest at any time if fraud, technical failure, or any other factor beyond the Sponsor’s control compromises the integrity of the Contest.

• Any attempt to tamper with the entry process, circumvent these Rules, or act in a disruptive manner may result in disqualification.

• The Sponsor’s decisions in all matters relating to this Contest are final and binding.

Personal information collected through this Contest will be used solely for administration of the Contest, winner notification, and prize fulfillment, in accordance with the Sponsor’s Privacy Policy available at sweetmarshmallow.co. By entering, you consent to the collection and use of your personal information for these purposes. For Canadian residents, this Contest complies with applicable Canadian privacy legislation.

Entry into this Contest does not constitute consent to receive commercial electronic messages from the Sponsor. Any subscription to the Sponsor’s mailing list requires separate, explicit consent.

This Contest is open to residents of Quebec. Any litigation respecting the conduct or organization of this publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. The Sponsor agrees to abide by any such ruling. Contest materials are available in French upon request.

This Contest is subject to all applicable federal, provincial, state, and local laws and regulations. For Canadian residents, this Contest is governed by the laws of Ontario and the federal laws of Canada applicable therein. For U.S. residents, this Contest is governed by the laws of Ontario, Canada, to the extent permitted by applicable law. Entrants submit to the exclusive jurisdiction of the courts of Ontario for any disputes arising out of this Contest.

The winner's Instagram handle will be announced on @sweetmarshmallowco's Instagram account on or around May 17, 2026. By entering the Contest, the winner consents to the use of their Instagram handle for announcement purposes without further compensation.
